The Department of Urban Development and Municipal Affairs, Government of West Bengal, has issued a significant amendment to the Kolkata Municipal Corporation (KMC) Certificate of Enlistment guidelines regarding correction, inclusion, and deletion of names in Trade Licenses or Certificates of Enlistment (CE).
The new provisions were introduced through Government Order No. 591 dated 12 August 2025 and provide a structured process for updating Trade License holder details across different business entities.
What Has Changed?
A new provision titled “Modalities of Corrections of Name of Certificate of Enlistment Holder(s)” has been added to the existing KMC Trade License Guidelines, 2020.
The amendment clarifies procedures for:
- Correction of holder’s name
- Inclusion of new partners or directors
- Deletion of existing names
- Updating records after resignation, death, transfer or restructuring
- Company amalgamation and mergers
1. Proprietorship Businesses
For sole proprietorship businesses, the existing trade license holder may apply for correction of name by submitting:
- Aadhaar Card (mandatory)
- Any one identity proof (EPIC, Passport, Driving Licence)
- Latest paid trade license receipt
- Details of any pending legal disputes, if applicable
These documents are required to support the requested correction in the Certificate of Enlistment records.
2. Partnership Firms
For partnership firms, applications must be jointly submitted by all partners.
Required documents include:
- Aadhaar and identity proof of all partners
- Existing partnership deed
- Modified or restructured partnership deed (if applicable)
- Latest payment receipt
- Details of any pending disputes
Special provisions have also been introduced for:
Deletion of Partner Due to Death
- Original death certificate of the deceased partner.
Inclusion of Legal Heirs
Where permitted by the original partnership deed, legal heirs may be inducted by submitting:
- Affidavit mentioning all legal heirs
- No Objection Certificate from surviving members
- Supporting legal documents
The mobile number of newly inducted partners may also be required for database updating purposes.
3. Companies, LLPs, Banks and Financial Institutions
For companies and LLPs, applications may be submitted by the existing holder or an authorised representative.
Documents required include:
- Aadhaar Card and identity proof
- Board Resolution authorising the change
- Mobile number of the proposed authorised person
- ROC Master Data or company records
- Latest payment receipt
- Details of pending litigation, if any
In cases involving:
- Amalgamation
- Merger
- De-merger
Relevant court orders must also be furnished to KMC.
How Will Applications Be Processed?
KMC has constituted a dedicated departmental committee to examine every application for name correction, inclusion or deletion. The committee consists of:
- Chief Manager (Licence)
- Licence Officer (HQ)
- Licence Officer (OL)
- Deputy Licence Officer
- Assistant Licence Officer
The local inspector of the concerned unit will also assist the committee during the scrutiny process.
Committee Meeting Schedule
Applications will generally be reviewed twice every month:
- Second Friday
- Fourth Friday
Additional meetings may be scheduled depending on application volume.
What Happens After Approval?
Upon approval:
- Supplementary demand, if applicable, will be generated.
- Updated records will be preserved digitally.
- The Certificate of Enlistment records will be modified accordingly.
If the application is rejected, the applicant will receive written communication stating the reasons for rejection.
